Fee schedule

Every fee, published. We quote follow-on work through your portal before it starts, and you pay through the platform the same way you paid your filing fee. Everything here is a flat fee except a request for reconsideration, which is billed by the hour and says so. Start with the $699 flat filing fee; everything below only matters if and when your matter needs it.

Filing

  • Our $349 attorney fee plus the $350 USPTO filing fee, itemized on your receipt. Covers review, preparation, filing, and one administrative office action response. Custom goods wording costs $200 more per class at the USPTO, and another $200 per class for each further 1,000 characters, quoted before we file.

  • A second set of eyes on the federal search$149

    An attorney reads the federal search results with you on a short call, for the names where the answer is not obvious. Credited in full against your filing fee if you go ahead.

  • Full clearance search + attorney opinionQuoted

    Federal, all 50 states, common law, domains, web, and social, run through a search vendor: ranked results with a written opinion letter and an attorney call. Quoted in writing before work starts. For a name the business is going to be built on.

If the USPTO writes back

Expect the USPTO to write back before it approves anything. That is normal, not a rejection. If yours does, one administrative response is already paid for.

  • Administrative office action (additional)$300

    Disclaimers, goods/services edits, specimen substitutions, entity corrections, and similar procedural fixes.

  • Complex office action$750

    Substantive refusals (descriptiveness, ornamentation, genericness) argued with citations to case law and statute.

  • Likelihood-of-confusion office action$1,500

    Section 2(d) refusals argued with real authority, one cited registration included; $500 for each additional cited registration.

  • Request for reconsideration after a final refusal$500 retainer + $350 / hr

    Billed by the hour against an advance deposit held in trust.

Intent-to-use follow-ons

  • Statement of use$500 / class

    Specimen selection, drafting, and filing. Includes the USPTO fee.

  • Extension of time$325 / class

    Six more months to file your statement of use. Includes the USPTO fee; we move your deadline on the docket, so the new date is the one we chase you about.

Keeping the registration alive

Your renewal dates go on your file the day the USPTO registers your mark, so you can see them coming, and we email you before each one. USPTO filing fees are included for the first class and every additional class. If a filing goes in during the six-month grace period, the USPTO adds $100 per class ($200 per class for a combined Section 8 and 9), which we quote separately.

  • 6-year renewal (§ 8)$1,000

    Includes the one-class USPTO fee. Each additional class $575.

  • 6-year renewal + incontestability (§ 8 + § 15)$1,400

    Adds the § 15 declaration that strengthens your registration against challenge. Each additional class $725.

  • 10-year renewal (§ 8 + § 9)$1,500

    Includes the one-class USPTO fees. Each additional class $800. Repeatable every ten years.

  • Monitoring$500 / yr

    Conflict reports across USPTO and WIPO filings, reviewed by an attorney, with a 15-minute attorney call whenever a report surfaces a real conflict.

About these fees

A flat fee is earned when you pay it, and we don’t hold it in a trust account. If we don’t finish the work you paid for, you’re entitled to a refund of whatever part of the fee we haven’t earned, and we’ll show you how we worked that out. If a filing doesn’t go in, we don’t keep the government’s portion of the fee: you choose whether we refund it or hold it toward your next one, and if we haven’t heard from you in three months, we refund it. Where a matter is billed by the hour, the retainer is an advance deposit against those hours, not a fee for keeping us available. It sits in our client trust account, we draw it down as time is billed each month, and any balance left when the matter ends comes back to you.

The $350 USPTO fee inside our price is the Office’s base filing fee per class. Since January 18, 2025 the USPTO adds $200 per class when goods and services are described in free text rather than picked from its ID Manual, another $200 per class for each further 1,000 characters of that text, and $100 per class for an application filed with required information missing. Our attorney review is designed to keep an application clear of all three. If one does apply to yours, we quote it before we file and itemize it on your receipt.
